IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE DOWNLOADING, INSTALLING OR USING THE SOFTWARE.

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Shanghai MagicCat Information Technology Co., Ltd. for the AI PAINTER software product, which includes computer software and associated media and online or electronic documentation ("Software").

本最终用户许可协议（"协议"）是您（个人或单一实体）与上海魔力猫信息科技有限公司就AI PAINTER软件产品（包括计算机软件、相关媒体和在线或电子文档，以下简称"软件"）达成的法律协议。

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

通过安装、复制或以其他方式使用本软件，您同意受本协议条款的约束。如果您不同意本协议的条款，请勿安装或使用本软件。

1. LICENSE GRANT

Subject to the terms and conditions of this Agreement, Shanghai MagicCat Information Technology Co., Ltd. grants you a limited, non-exclusive, non-transferable license to:
a) Install and use the Software on a single computer or gaming device.
b) Create and use images generated through the Software's AI Image Generation feature.

根据本协议的条款和条件，上海魔力猫信息科技有限公司授予您有限的、非独占的、不可转让的许可，以便：
a) 在单一计算机或游戏设备上安装和使用本软件。
b) 创建和使用通过本软件的AI图像生成功能生成的图像。

2. AI IMAGE GENERATION TECHNOLOGY

This Software utilizes AI image generation technology powered by Stable Diffusion, an open-source framework that leverages the Stable Diffusion 1.5 model. Additionally, custom LoRA (Low-Rank Adaptation) models trained on Stable Diffusion 1.5 are employed to influence the generated images.

本软件使用由Stable Diffusion提供支持的AI图像生成技术，Stable Diffusion是一个利用Stable Diffusion 1.5模型的开源框架。此外，基于Stable Diffusion 1.5训练的自定义LoRA（低秩适应）模型也被用于影响生成的图像。

3. OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS

The Software is licensed, not sold. Shanghai MagicCat Information Technology Co., Ltd. retains all rights, title, and interest in and to the Software, including all intellectual property rights. Stable Diffusion and its models are subject to their respective open-source licenses.

本软件是授权使用，而非出售。上海魔力猫信息科技有限公司保留对软件的所有权利、所有权和利益，包括所有知识产权。Stable Diffusion及其模型受其各自开源许可的约束。

4. USER-GENERATED CONTENT

4.1 Ownership: You retain ownership rights to the images you generate using the Software's AI Image Generation feature, subject to the underlying rights of the Stable Diffusion framework and any third-party rights in content that may have influenced the AI models.

4.1 所有权：您保留对使用本软件的AI图像生成功能所生成图像的所有权，但须遵守Stable Diffusion框架的基础权利以及可能影响AI模型的任何第三方内容权利。

4.2 Usage Rights: You are granted non-exclusive rights to use, reproduce, display, and distribute images you generate with the Software for personal and commercial purposes, provided such use complies with applicable laws and the restrictions in this Agreement.

4.2 使用权：您被授予非独占权利，可以将您使用本软件生成的图像用于个人和商业目的的使用、复制、展示和分发，前提是此类使用符合适用法律和本协议的限制。

5. USER RESTRICTIONS

You agree not to use the Software's AI Image Generation feature to create images that are:
a) Illegal, harmful, or offensive.
b) Infringing upon the intellectual property rights of others (including copyright, trademarks, and patents).
c) Defamatory, libelous, or slanderous.
d) Sexually explicit or that exploit, abuse, or endanger children.
e) Promoting violence, discrimination, or hatred.

您同意不使用本软件的AI图像生成功能创建以下图像：
a) 非法、有害或冒犯性的图像。
b) 侵犯他人知识产权（包括版权、商标和专利）的图像。
c) 诽谤、中伤或诋毁性的图像。
d) 性暗示、色情或利用、虐待或危害儿童的图像。
e) 宣扬暴力、歧视或仇恨的图像。

Shanghai MagicCat Information Technology Co., Ltd. reserves the right to disable or restrict access to the Software for any user who violates these terms.

上海魔力猫信息科技有限公司保留对违反这些条款的任何用户禁用或限制对软件的访问的权利。

6. OPEN SOURCE COMPONENTS

The Software incorporates open-source software components, including Stable Diffusion, which is licensed under the CreativeML Open RAIL-M license. Your use of these components is subject to their respective licenses. Information regarding these licenses is provided in the Software documentation.

本软件包含开源软件组件，包括根据CreativeML Open RAIL-M许可证授权的Stable Diffusion。您对这些组件的使用受其各自许可的约束。有关这些许可证的信息在软件文档中提供。

7. DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SHANGHAI MAGICCAT INFORMATION TECHNOLOGY CO., LTD. DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

本软件按"现状"和"可用性"提供，不提供任何明示或暗示的保证，包括但不限于对适销性、特定用途适用性和非侵权性的保证。上海魔力猫信息科技有限公司不保证软件将不中断、无错误或不含有害成分。

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SHANGHAI MAGICCAT INFORMATION TECHNOLOGY CO., LTD. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF SHANGHAI MAGICCAT INFORMATION TECHNOLOGY CO., LTD. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

在适用法律允许的最大范围内，上海魔力猫信息科技有限公司在任何情况下均不对因使用或无法使用本软件而产生的任何间接、附带、特殊、后果性或惩罚性损害（包括但不限于利润损失、数据、使用、商誉或其他无形损失的损害）承担责任，即使上海魔力猫信息科技有限公司已被告知此类损害的可能性。

9. TERMINATION

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Shanghai MagicCat Information Technology Co., Ltd. if you fail to comply with any term of this Agreement. Upon termination of this Agreement, you shall cease all use of the Software and destroy all copies of the Software.

本协议自生效起持续有效，直至终止。如果您未能遵守本协议的任何条款，您在本协议下的权利将在没有上海魔力猫信息科技有限公司通知的情况下自动终止。本协议终止后，您应停止使用本软件并销毁所有软件副本。

10. GOVERNING LAW

10. 适用法律

This Agreement shall be governed by and construed in accordance with the laws of the People's Republic of China. Any disputes arising from or in connection with this Agreement shall be submitted to the jurisdiction of the competent courts in Shanghai, China.

本协议受中华人民共和国法律管辖并据其解释。因本协议引起的或与之相关的任何争议应提交上海有管辖权的法院。

11. AMENDMENTS

11. 修改

Shanghai MagicCat Information Technology Co., Ltd. reserves the right to modify or update this Agreement at any time. Any changes will be effective upon posting within the Software or through other reasonable means of notice. Your continued use of the Software after any such changes constitutes your acceptance of the revised Agreement.

上海魔力猫信息科技有限公司保留随时修改或更新本协议的权利。任何变更将在软件内发布或通过其他合理通知方式生效。在任何此类变更后继续使用本软件，即表示您接受修订后的协议。
